Chapter & Crown Booksellers LLC

Terms of Service

Effective Date: October 1, 2026

OVERVIEW

Welcome to Chapter & Crown Booksellers! The terms “we,” “us” and “our” refer to Chapter & Crown Booksellers LLC. Chapter & Crown Booksellers operates this store and website, including all related information, content, features, tools, products and services made available through the website.

These Terms of Service describe your rights and responsibilities when you visit, interact with, or use our website and services.

By accessing or using our website or services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please do not use our website or services.

Our store is hosted by Shopify, which provides us with the online commerce platform that allows us to offer our products and services to you.

SECTION 1 - ACCESS AND ACCOUNT

You must be the age of majority in your state or province of residence to use our Services, or you must have the consent of your parent or legal guardian to use our Services.

When you use our Services, you may be asked to provide certain information, including your email address, billing information, payment information, shipping address, or other information necessary to process your order.

You agree that all information you provide to us is accurate, current, and complete, and that you have the right to provide such information.

You are responsible for maintaining the confidentiality of any account credentials you use to access our Services and for all activities conducted through your account.

You may not transfer, sell, assign, or license your account to another person without our prior written consent.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to accurately describe and represent the products offered through our Services.

However, colors, images, and other product characteristics may appear differently depending on your screen, device, browser, or other technical factors.

Product descriptions, specifications, pricing, availability, and other information may be changed or updated from time to time.

We reserve the right to discontinue products, limit quantities, or restrict availability to particular customers, geographic areas, or jurisdictions when reasonably necessary.

Certain products, including specialty, limited, signed, collectible, exclusive, or special-edition products, may have additional terms or restrictions that will be clearly disclosed on the applicable product page before purchase.

SECTION 3 - ORDERS

When you place an order through our Services, you are submitting an offer to purchase the products in your order. We reserve the right to accept or decline an order for any lawful reason.

An order is not considered accepted until we confirm the order.

Payment may be processed before an order is accepted. If we are unable to accept, fulfill, modify, or cancel an order, we will notify you using the contact information provided with the order and will issue any applicable refund.

Once an order has been accepted, we may not always be able to accommodate cancellation requests, particularly after an order has entered processing or fulfillment, except as otherwise provided in our Purchase Options Cancellation Policy.

For pre-order products, customers may request cancellation before the order has shipped in accordance with our Purchase Options Cancellation Policy. Once a pre-order has shipped, it is subject to our normal Return & Refund Policy.

By placing an order, you agree to provide accurate and complete information necessary for us to process and deliver the order.

SECTION 4 - PRICES AND BILLING

Prices, discounts, promotions, and other offers are subject to change at any time.

The price charged for a product will generally be the price displayed at the time the order is placed, as reflected in your order confirmation, unless otherwise stated.

Posted prices do not necessarily include applicable sales taxes or shipping charges, which may be calculated and displayed during checkout.

Prices and promotions offered through our website may differ from prices or promotions offered by physical stores, third-party sellers, marketplaces, or other sales channels.

Promotional offers may be subject to additional terms. If the terms of a specific promotion conflict with these Terms of Service, the terms of the promotion will control for that promotion.

SECTION 5 - SHIPPING AND DELIVERY

We offer shipping within the United States according to the shipping options and rates displayed at checkout.

Our standard shipping option is $6.99 for orders under $50 and free for orders of $50 or more, with an estimated delivery time of 3–5 business days after shipment.

An express shipping option is available for $15, with an estimated delivery time of 1–2 business days after shipment.

Delivery estimates are estimates only and are not guaranteed. Actual delivery times may vary because of carrier delays, weather, holidays, service interruptions, address issues, or circumstances outside our reasonable control.

Order processing time is separate from the carrier transit time. Orders may require processing before being transferred to a shipping carrier.

For pre-order products, the expected release or shipping date displayed on the product page is based on information available from the publisher or supplier and may change. Publisher or supplier release dates are not controlled by Chapter & Crown Booksellers.

If an order contains both in-stock products and pre-order products, the items may ship separately. We will not charge additional shipping solely because an order is divided into multiple shipments.

Customers are responsible for providing an accurate and complete shipping address. If an order is returned because of an incorrect or incomplete address, additional shipping charges may apply.

If a shipment is lost, damaged, substantially delayed, or otherwise appears to have a delivery problem, please contact us at hello@chapterandcrownbooks.com with your order number and relevant details so that we can assist you.

Where an order cannot be shipped within the applicable timeframe, we will provide any notices, options, cancellations, or refunds required by applicable law.

Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Chapter & Crown Booksellers.

SECTION 7 - OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control or input.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new features through the Services, including the release of new tools and resources. Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain materials and hyperlinks to websites provided or operated by third parties, including embedded third-party functionality.

We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access.

If you decide to leave the Services to access these materials or third-party sites, you do so at your own risk.

We are not liable for any harm or damages related to your access of any third-party websites or your purchase or use of any products, services, resources, or content on any third-party websites.

Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction.

Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Chapter & Crown Booksellers is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Chapter & Crown Booksellers.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Chapter & Crown Booksellers, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, demands, and liabilities arising from or related to your purchases and transactions with Chapter & Crown Booksellers.

SECTION 10 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy.

By using the Services, you acknowledge that you have read our Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve its services.

Information you submit to the Services may be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you.

Please review our Privacy Policy for more information about how Chapter & Crown Booksellers collects, uses, and protects personal information.

SECTION 11 - FEEDBACK

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use.

We may, for example, use our rights under this license to operate, provide, evaluate, enhance, improve and promote the Services and to perform our obligations and exercise our rights under the Terms of Service.

You also represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms.

We are under no obligation to maintain your Feedback in confidence, pay compensation for your Feedback, or respond to your Feedback.

We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right.

You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website.

You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback.

You are solely responsible for any Feedback you make and its accuracy.

We take no responsibility and assume no liability for any Feedback posted by you or any third-party.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.

If an error affects an order that you have already placed, we will communicate with you and provide any cancellation or refund options required by applicable law.

(i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Chapter & Crown Booksellers, Shopify or users of the Services, or expose them to liability.

In addition, you agree not to:

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

SECTION 14 - AGENTS

14.1 This section (“Agent Terms”) applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. “Agent” means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using persons, without direct supervision.

14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.

14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: “Agent/[agent name]”; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a computer, and (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

SECTION 15 - TERMINATION

We may terminate this agreement or your access to the Services, or any part thereof, in our sole discretion at any time without notice.

Termination does not eliminate your responsibility for amounts properly due and payable for purchases made before termination.

The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

SECTION 16 - DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services and all products, content, information, materials, and functionality made available through the Services are provided on an “as is” and “as available” basis.

Chapter & Crown Booksellers makes no representations or warranties of any kind, express or implied, regarding the operation of the Services or the accuracy, completeness, reliability, availability, or suitability of any information, content, products, or services made available through the Services, except as expressly stated in these Terms or required by applicable law.

To the fullest extent permitted by law, Chapter & Crown Booksellers disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and warranties arising from course of dealing, course of performance, usage, or trade.

We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components.

We do not warrant that the results obtained from use of the Services will be accurate, complete, reliable, or suitable for your particular purposes.

Product information, availability, pricing, release dates, shipping estimates, and other information may be provided to us by publishers, distributors, suppliers, carriers, or other third parties. Although we make reasonable efforts to provide accurate information, we do not warrant that such information will always be complete, current, or error-free.

Nothing in these Terms is intended to exclude or limit any warranty, right, or remedy that cannot lawfully be excluded or limited under applicable law.

SECTION 17 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Chapter & Crown Booksellers, its owners, officers, employees, agents, affiliates, licensors, service providers, contractors, suppliers, or other representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the Services or any products purchased through the Services.

This limitation includes, without limitation, damages arising from loss of profits, revenue, business opportunities, goodwill, data, or other intangible losses, even if Chapter & Crown Booksellers has been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, Chapter & Crown Booksellers' total aggregate liability arising out of or relating to these Terms, the Services, or any product purchased through the Services shall not exceed the amount you actually paid to Chapter & Crown Booksellers for the specific product or products giving rise to the claim during the transaction from which the claim arose.

Nothing in these Terms shall exclude or limit liability that cannot legally be excluded or limited under applicable law, including liability arising from fraud, willful misconduct, or other liability for which applicable law prohibits limitation.

SECTION 18 - INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Chapter & Crown Booksellers LLC and its owners, officers, employees, agents, affiliates, licensors, service providers, contractors, suppliers, and representatives from and against claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

SECTION 19 - SEVERABILITY

If any provision of these Terms of Service is determined by a court or other competent authority to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law.

If the provision cannot be enforced, it shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.

The remaining provisions shall continue in full force and effect.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

A waiver of any particular breach shall not constitute a waiver of any subsequent breach.

Entire Agreement

These Terms of Service and any separate agreements through which we provide Services shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict-of-law principles.

To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be brought in the state or federal courts located in Ohio, and you consent to the jurisdiction and venue of those courts.

Nothing in this Section prevents either party from seeking emergency or equitable relief from a court of competent jurisdiction when such relief is available under applicable law.
